Eligibility

The Service

Cinie is a platform that allows users to discover, track, rate, review, rank, discuss, list, and share movies, television shows, and related entertainment content, and to interact with other users. We may add, remove, or modify features at any time without prior notice.

User Content

The Service allows you to post, upload, submit, store, or share content, including reviews, ratings, comments, profile information, lists, images, and other materials (“User Content”). You retain ownership of your User Content. By posting or submitting User Content through the Service, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify, adapt, publish, display, perform, distribute, and use that User Content for the purpose of operating, improving, promoting, and providing the Service. You represent and warrant that you own or control all rights necessary to submit the User Content, your User Content does not infringe or violate the rights of any third party, and your User Content complies with these Terms and applicable law.

Content and Conduct Rules

Reviews, Ratings, and Community Features

Our app allows users to post opinions, reviews, ratings, rankings, and recommendations. These are user opinions only and do not represent our views. We do not guarantee the accuracy, quality, or reliability of user-submitted content.

Moderation and Enforcement

We reserve the right, but not the obligation, to monitor, review, screen, remove, edit, restrict, or refuse any content or account at any time, with or without notice, for any reason, including suspected violations of these Terms or applicable law. We may suspend or terminate accounts that violate these Terms or that create risk for us, our users, or third parties.

Your use of third-party services is at your own risk and subject to their terms. The Service uses movie and television data provided by The Movie Database (TMDB). We are not endorsed by or affiliated with TMDB.

App Stores

If you access the Service through the Apple App Store or Google Play, you acknowledge that these Terms are between you and us, not with Apple or Google, and that Apple and Google are not responsible for the Service or its content.

Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and disclose information.

Paid Features

Certain features of the Service may be offered for a fee in the future. If you purchase any subscription or premium feature, you authorize us or our payment processor to charge the applicable fees. Fees are non-refundable except as required by law. We may change pricing with reasonable notice.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $100 USD.

Indemnification

You agree to defend, indemnify, and hold harmless our team from any claims, liabilities, damages, losses, costs, and fees arising out of your User Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party rights.

Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules.

Dispute Resolution

Any dispute arising out of these Terms or the Service will be resolved exclusively in the state or federal courts located in New Jersey, and you consent to personal jurisdiction in those courts.

We may update these Terms from time to time. If we make material changes, we will post the updated Terms and update the “Last Updated” date. Your continued use of the Service after updated Terms become effective means you accept the revised Terms.
